Employers Policies & Handbooks Updates | Legacy Law Firm

Employers should be aware of two new federal laws effective in 2023: the Pregnant Workers Fairness Act (PWFA) and the Providing Urgent Maternal Protections (PUMP) for Nursing Mothers Act (PUMP Act).   A change to the Fair Labor Standards Act now requires employers with 50 or more employees to provide reasonable break time for all employees, including salaried employees, to express breast milk as needed. Effective June 2023, employers with 15 or more employees must provide reasonable accommodations to allow pregnant workers to perform the essential functions of their positions.

Employers should review and update their handbooks, policies, and practices to ensure they comply with these updated laws. Contact us at (605) 275-5665 to review your current policies and to customize such policies for your company and workplace.
